A 33-year-old Ohio woman is charged with abuse of a corpse and will have to face a grand jury on accusations of trying to flush her 22-week fetus down the toilet after suffering a miscarriage.

Oh my gosh, that's aweful. I can't quite understand how she broke the law though? She miscarried and the fetus was already not viable or alive. What was she supposed to do? Take it to the hospital anyway?

Kind of an odd story. I mean she's 33 not 16. And she had gone to the hospital but sounds like she left against medical advice, but she's allowed to do that. Apparently she miscarrying and it was a natural event. There isn't any evidence that she did intentional harm. And she didn't know what to do or how to proceed so I don't support charging her.

Yes, I agree with everyone you said,@fuzzems. She went to the hospital to try and get help, it's not like she didn't try. I am still wondering what she was supposed to do anyway. I guess she could have called the hospital for advice, after it happened.
The poor woman was probably in pain and really upset as it was. Sometimes laws just don't make any sense. No common sense in place anyway.

I think most women would probably have called someone for help, called an ambulance or tried to get to the hospital. And that was pretty dangerous, women can bleed to death with the after birth, etc if there are complications. It's a strange situation but doesn't sound like a criminal act.

No special consideration is given to an aborted baby's body, just the opposite in fact. Why is it "abuse of a corpse" for the attempted disposal of a baby that died in utero before exiting the mother's body (as was confirmed and acknowledged by a forensic exam and the prosecuting attorney?) So when exactly is a person an actual person in the eyes of the law? A viable baby that was aborted is just "medical waste," but a miscarried baby is a "corpse." You can't have it both ways. I guess that's why the reporter in the OP video said Ohio Physicians For Reproductive Rights are concerned about this case. Once you start acknowledging a dead baby is a person who a mother must show concern for its passing and treatment of its corpse with respect or be prosecuted what does that say about all the aborted babies tossed away in garbage bags outside of abortion clinics. There have even been people who have removed those "medical waste" bodies to give them dignified burials that were considered in violation of the law for doing so.
